A buyer wanting representation must sign a buyer representation agreement and be given a copy, this is a contract. CT Real Estate Reg. Sec. 20-328-6a(a)(2); CT real Estate Commission's Policy on Agency, 4.
An Agent of a Real Estate brokerage firm CANNOT show a buyer another firm's listing(s) without a written signed buyer representation agreement.....CT Real Estate Reg. Sec. 20-328-6a(a)(2); CT real Estate Commission's Policy on Agency, 5c.
Being a Realtor is a lot of fun. I take great pride in my listings and in working with my buyers. One of my favorite things about this job is that I help bring a concept of being a homeowner to reality. Kind of like Walt Disney, making dreams come true.
Let's talk about a Buyers Agent. This is a Realtor who represents the buyer only. The Buyers agent has fiduciary responsibility to his/her client, meaning that the Agent will not disclose anything personal, confidential or financial, to anyone including the seller unless authorized to do so by the client or buyer. It is the same responsibility that is given to the seller by the sellers agent. Don't be fooled by the sellers agent at the Open houses, they represent the Seller and are working to sell that particular house. An Agent can be either Sellers or Buyers Agent, and if agreed upon by both parties, can represent both sides. However, if you do not sign a Exclusive Right to Represent Buyer form, you are NOT represented and are entering into a contract at your own risk.
Now here's what I love about being a Buyers Agent, when working between my client (Buyer) and the sellers Agent when bringing an offer in, sometimes the Sellers Agent will make a big deal out of how low the offer is. This is the fun part, I quote the law to the agent which basically is The Listing Agent must present all offers to the Seller for the Seller to make a decision on whether to accept, reject or make a counter-offer. Believe it or not some agents are offended by an offer, but its not up to them... it's up to the seller. The negotiations can go back and forth a few times, until there is an agreement which results in the buyers agent writing up a final offer agreement or contract, depending on where you live.
Once there is an agreement in terms and price, it is up to the buyers agent to help keep the buyer and transaction on track to close. This includes being at the home inspection asking questions of the inspector, talking to the lender keeping them on track, discussing issues with the attorney's and the buyer, making sure dates are met, utilities have been called and finally being with the buyer when they close. There are a lot of things that do go on and looking at this one paragraph makes it seem so small, but let me assure you there are hours of work over the six weeks it takes to bring a deal from offer, to closing.
And when you hand that key over to your buyer........... you see the excitement and magic!!
